			<content:encoded><![CDATA[<p>Natalie Hoernschemeyer and Wendy Kasten successfully represented a Missouri school district against a lawsuit requesting a temporary restraining order and preliminary and permanent injunctive relief preventing the school district from declaring two students to be ineligible to participate in sports for 365 days.  Prior to an evidentiary hearing on the temporary restraining order, the Mickes Goldman O’Toole attorneys sought dismissal of the suit, arguing that it failed to state a claim because Missouri school students do not have a constitutionally protected property interest in participating in extracurricular sports.  After oral argument, on April 26, 2012, the trial court agreed with the District and dismissed all of the claims against the District with prejudice.</p>

			<content:encoded><![CDATA[<p>Sarah Rubenstein recently won a judgment in a rent and possession action brought on behalf of Walmar Investment Company. Walmar brought suit in the Circuit Court of St. Louis County to regain possession of its property from a holdover tenant, Don DeFoe Flowers, Inc., and to collect several months in back rent. The tenant moved out of the property shortly after suit was filed, but alleged it was not liable for back rent pursuant to an alleged settlement agreement between the parties.</p>
<p>On January 31, 2012, a trial was held before Judge Ellen Ribaudo. At the close of evidence, the Judge asked for post-trial briefing on the settlement issue. Shortly after Rubenstein filed a brief on behalf of Walmar, the Judge issued a judgment in favor of Walmar for the complete amount of unpaid rent requested, as well as $7500 in attorney’s fees, and all court costs.</p>
<p>Walmar Investment Company is a commercial real estate developer that provides unique commercial opportunities for sale and lease in St. Louis and St. Charles Counties.</p>

			<content:encoded><![CDATA[<p>Natalie Hoernschemeyer and Christi Flaherty recently defeated a class action lawsuit against Moberly Area Community College.  The College was among several Missouri colleges sued by their students, inter alia, the Missouri Returning Heroes Act (a statute that caps the tuition for veterans returning from combat at $50.00 per credit hour).  The students alleged that the colleges were misapplying their financial aide under the Act, the Court disagreed. </p>
<p>In a case of first impression, Mickes Goldman O&#8217;Toole attorneys and other co-defendants’ counsel sought dismissal of the suit, based on the fact that the student who attended the  College never paid more than $50.00 per credit hour.  The College also argued that the suit was improper because the statute specifically stated that all other financial aide was to be applied to the tuition before the Heroes Act cap, and thus was not intended to limit the amount of tuition the College could collect from other sources. </p>
<p>On July 5, 2011, St. Louis County Judge Ellen Siwak heard arguments from the parties on the motion to dismiss, and on December 5, 2011, she granted the colleges’ motion, and dismissed the case.</p>

Hannibal Public School District #60, et al.  The case concerned a student’s claim that his long term discipline for making death threats against specific students was protected by the First Amendment’s Freedom of Speech, as the death threats were conveyed via Instant Messenger, from a personal computer, after school hours.</p>
<p>The District argued its discipline decision was justified because the statements were “True Threats” and these statements caused a substantial disruption in the District’s efficient operation of the high school.  After being awarded summary judgment by the District Court, Plaintiff appealed and on August 1, 2011, the Eighth Circuit affirmed the decision in the District’s favor.  </p>
<p>This decision represents a significant victory for Missouri public school districts, as it confirms their ability to proactively respond to threatening electronic communications without the threat of liability for First Amendment violations. 			<content:encoded><![CDATA[<p>Tom Mickes and Betsey Helfrich successfully represented the Carthage R-IX School District in an appeal of a teacher termination proceeding before the Missouri Court of Appeals, Southern District.  After a hearing before the District’s Board of Education, the Board terminated the Director its Parents as Teachers Program for immoral conduct.  The evidence at the hearing before the Board of Education revealed that the Director approved her subordinate’s trip to a jail nearly two hours away from the District to visit a Parents as Teachers client who was in jail awaiting deportation due to her illegal immigrant status.  While at the jail, the Parents as Teachers educator solicited the adoption of the woman’s minor child.  After reviewing the evidence, the Board of Education determined that the Director was aware of the illicit purpose for her subordinate’s trip to the jail, that the Director supported the visit with District funds, and helped conceal the true nature of this visit for nearly two years.  The Board found that the Director’s participation in this matter defied the very spirit and purpose of the Parents as Teachers Program.  The Board voted 6-0 to terminate the Director for her participation in the solicitation of adoption of a minor child.   </p>
<p>The Director, a tenured teacher in the district, appealed to Circuit Court of Jasper County and then eventually brought the case before the Missouri Court of Appeals, Southern District.  Following briefing and oral argument, the Missouri Court of Appeals upheld the termination decision of the Board of Education.  In June 2011, Ms. Homa’s application for transfer for review was denied by the Missouri Supreme Court.</p>
